LUMAX GENERAL CONDITIONS: We reserve the right to refuse shipment of customer’s purchase order if we determine the destination is outside of the distributor’s normal trading area. Orders submitted, receipt of catalogs and price sheets do not constitute agreement to sell. All orders are subject to corporate office approval. Wattage ratings and/or specifications, as posted in our catalog, may be altered by Lumax in the event that the U.L. Procedures change.
PRICING AND SPECIFICATIONS: All pricing and specifications listed in this price sheet are subject to change without notice. All prices are subject to Federal and Provincial taxes where applicable.
CREDIT: A completed and signed credit application, as well as signed resale certificate is required for all new accounts. Accounts opened on prepay terms must submit payment in full with each purchase order to facilitate processing of the order.
PAYMENT TERMS: Net 30 days from date of invoice on approved accounts. All orders are subject to acceptance by Lumax, and prior approval by our credit department. Service charge of 1 ½% per month will be added to all invoices not paid within 30 days.
OPENING ORDERS: A $2,000 minimum order is required to open a stocking dealer account with Lumax.
MINIMUM RE-ORDERS: A $10.00 service charge will be added to any order less than $100.00 except for replacement parts or glass. Lumax accepts Visa, M/C, Discover, American Express and Company Checks.
FREIGHT: All orders are shipped freight pre-paid if order meets net minimum requirement of $1500.00. All goods are shipped F.O.B. Lumax warehouse: Ontario, California. Deliveries to residential address will incur additional freight charges above and beyond prepaid freight allowance. This policy applies only to accounts that are shipped within the continental U.S.A. Lumax reserves the right to select the carrier, unless special arrangements are made prior to shipment. Received orders are placed for shipment on the next available ship date. All shipping and handling charges are estimates only and actual charges may vary. A $10.00 service fee will be added to all drop shipments.
FREIGHT CLAIMS: Visible/concealed damage or Loss in transit must be noted on the freight bill from delivering carrier. We recommend that you note, “subject to exceptions” on your freight delivery receipts. All truck line shipments are shipped shrink-wrapped, please note on freight bill if you received loose cartons. Lumax cannot assume responsibility for damage or loss occurring in transit that has not already been reported to delivering freight carrier. A package found with concealed damage that was signed for in good condition must be reported to delivering freight carrier within five days of receipt for inspection. Lumax RGA Department must also be contacted at this time in order to begin claim processing.
CUSTOM ORDERS: All custom/commercial/contract job orders are non-cancelable and non-refundable and require a 50% deposit with order placement, balance due prior to shipping.
CANCELLATIONS: Cancellation requests must be made in writing to our Customer Service Department prior to shipping. A 20% restocking fee will be charged if shipment has already left the warehouse.
LIABILITY: Lumax is not responsible for any charges involved in repairing or replacing damaged or defective merchandise or damages caused by improperly installed unit or units in which parts have been tampered with or substituted.
PARTIAL RELEASE: Partial release of an order, if requested by the customer will result in separate freight charges for each shipment.
RETURN OF GOODS: No goods may be returned without written Return Goods Authorization. All returns must be submitted to Lumax with the completed RGA requests form. Purchase order numbers and invoice numbers are required along with a valid return reason. Any requests sent without the correct information will not be processed. TO BE
ELIGIBLE FOR CREDIT, FIXTURES MUST BE IN ORIGINAL FACTORY CARTONS. Customer will be charged a restocking fee of 20% of invoice value, plus return freight, within six months of invoice date. All returns are inspected, and credit may be forfeited if damage occurred due to improper repackaging. All returns must be sent via our preferred carrier. Fixtures considered defective in material or workmanship will be replaced or credited at our discretion, within one year from date of invoice. Replacement parts for damaged products will be available for one year from product invoice date. Lumax shall not be responsible for any other damage or loss, which may be sustained or claimed. Any goods returned to Lumax without written authorization will be refused and returned at distributor’s expense.
LUMAX Limited Warranty
Lumax, warrants its’ products against structural and finish defects for three (3) years from date of shipment. Products that are stored or used in extremely damp and/or salty air conditions, which includes, but not limited to, intense sunlight, high winds, or acid rain, where product tends to tarnish easily, are warranted to one (1) year from date of shipment. Lumax will replace, at our discretion, products that fail to operate structurally, within the warranty period. This warranty does not cover products that were improperly installed or those in which parts have been tampered with or changed. The compliance of our product to project specification and approval for their use is not warranted by our company. Product sold as “Discontinued” or “Close-Out”, is not warranted by our company and is not returnable. Lumax, will not be responsible or liable to buyer, its’ agents employees, customers, or any third party for cost incurred in the removal or reinstallation of any product, or any incidental damages resulting in loss of use, lose of revenue, loss of profit, arising out of, or in connection with natural disaster, catastrophe, fault or negligence of the user of any third party, including with out limitation, shipping and/or damage. Except as stated herein, there are no warranties expressed or implied. Warranty period begins on date of shipment from Lumax.
